Residential Approval - Noel Street, Hendra

The Planning Place has successfully obtained approval for House Extensions on a Small Lot in a Traditional Building Character Overlay at 16 Noel Street, Hendra. The approved works involve additional habitable rooms, a new garage and driveway crossover, and a new patio to the existing pre-1946 dwelling house.

Minor demolition work on the lower floor level and balustrading on the front verandah was considered Exempt Development under the Traditional Building Character Overlay of the Brisbane City Plan 2014 because it had been identified as a post-1946 extension. The proposal to enclose the lower floor and roofed patios on the eastern façade was also considered Exempt Development under Building Work for a Dwelling House on a Small Lot as it was contained within the prescribed building envelope.

Performance solutions were sought with regard to the roofed patio height and garage setback. The proposed works were assessed against the applicable codes of the Brisbane City Plan 2014 and it was demonstrated that the development was able to meet the intent of the Performance Outcomes.

Residential Approval - Grove Street, Albion

The Planning Place has recently obtained confirmation from Council that the proposed change at 71 Grove Street, Albion is Generally In Accordance (GIA) with the original approval for Dwelling House Extensions from March, 2015. The minor alterations involve the garage door materials – the existing design was considered impractical given the proximity of the dwelling to the boundary,

It was proposed to use a standard steel sectional door that will have the appearance of timber horizontal cladding. The door will present as a more lightweight, compact door design, and would replace the bulky tilt-up style door that as present would protrude past the boundary when open. Whilst vertical timber pailings were explored as an alternate option, this was discovered to be impractical owing to inevitable pinch points.

Ultimately, it was determined that the proposed development could be considered ‘Generally In Accordance’ with the existing development approval.

Residential Approval - Annie Street, New Farm

The Planning Place has recently obtained approval for Dwelling House (Small Lot) Extensions in a Traditional Building Character Overlay at 33 Annie Street, New Farm. The works were approved to the post-1946 dwelling house that was approved in 2005. The works involve an exempt extension to the rear, enclosure of the existing lower storey garage and partial enclosure of the upper storey balcony, as well as a new carport between the existing dwelling and the front boundary.

Residential Approval - Garfield Road, Logan Road

The Planning Place has successfully obtained approval for Multiple Dwellings (8 Townhouses) at 50 Garfield Road, Logan Central. Located within the Townhouse Precinct of the Low-Medium Density Residential Zone, the approved development will feature eight two-bedroom dwellings that will have an equivalence of 5.6 dwellings. The Townhouse Precinct in particular encourages medium density development in the form of two storey units, so as to further diversify the dwelling options within the area. It was determined that the proposal was in accordance with the density requirements of the Logan Planning Scheme 2015 with an allowable density of 5.7 in the precinct. This will provide the precinct with a maximum net density of 40 equivalent dwellings per hectare which is strongly supported by council (see AO4 of the Low-Medium Density Residential Zone Code).

A full engineering assessment was also provided as part of the development application, outlining that the site is serviced by all necessary infrastructure.

Residential Approval - Brentnall Street, Norman Park

The Planning Place has successfully obtained approval for Reconfiguring a Lot (2 into 2 Lots), Partial Demolition in a Traditional Building Character Overlay and Multiple Dwellings (4 Units) at 69-71 Brentnall Street, Norman Park. The proposal sought performance solutions regarding lot dimensions and bulk and scale of the dwellings. Recent approvals issued by Council, including 34 Aubigney Street, Annerley (Council reference: A004020212) were used as precedence to argue the proposed developments would be sited in a manner consistent with the surrounding area. The approved Multiple Dwellings will be in compliance with the performance criteria for Multiple Dwellings.

Residential Approval - Price Street, Oxley

The Planning Place has successfully obtained approval for two new Dwelling Houses on Small Lots at 35 and 37 Price Street, Oxley. The lots are currently subject to an existing approval (A004451623) for a realignment of boundaries creating two small lots. The recent approvals involve dwelling houses each featuring a double garage and entry hall, a family/dining kitchen space, a study room, a laundry, two bathrooms, four bedrooms and walk in robe. The proposals were subject to Code Assessment due to minor non-compliances with the Dwelling House (Small Lot) Code, and were read in conjunction with one another.

Residential Approval - Grandview Road, Pullenvale

The Planning Place has successfully obtained approval for Animal Keeping (Horse Stables) in a rural area at 317 Grandview Road, Pullenvale. The approved works involve the construction of stables and an adjoining day yard towards the front of the site – clear of any ecologically important areas – to house potentially fifteen (15) horses at any one time. The building will also incorporate a hay shed, tack room, small office, and amenities. The finished development will have a gross floor area of 548m2 (or 1.62% of the site area).

In accordance with the Brisbane City Plan 2014, the proposal triggered a code assessment application where it is a proposal for Animal Accommodation of an animal other than cats or dogs.

Residential Self-Assessable Certificate - Todd Street, Taringa

The Planning Place recently provided the proposed residence at 24 Todd Street, Taringa a self-assessable development certificate. Pursuant to state and local planning legislation, the proposal did not trigger a development application. It was proposed to construct a new Dwelling House on the subject premises in accordance with the use definition under the Brisbane City Plan 2014:

‘A residential use of premises for one household that contains a single dwelling. The use includes outbuildings and works normally associated with a dwelling and may include a secondary dwelling’.

The self-assessable certificate was to confirm that the dwelling house would not exceed two (2) storeys in accordance with the self-assessable criteria of the Dwelling House Code. The proposed development will have an overlapping area that is not considered a storey including stairs, a laundry, and a basement area. The basement level will also be achieved from excavation further down from the natural ground level and, therefore, is not considered a storey.

The information provided by the self-assessable development gave legal evidence that the proposed dwelling house does not require assessment by Brisbane City Council having been professionally reviewed by the team at The Planning Place. Residential Approval - Melon Street, Mansfield

Recently, The Planning Place has obtained approval for a new Dwelling House on a Small Lot at 4A Melon Street, Mansfield. The approved design features a double garage and entry hall, a family, dining kitchen space, a media room, a laundry, a bathroom and four bedrooms.

The development proposed performance solutions that were considered appropriate against AO2.1 and AO2.5 of the Dwelling House (Small Lot) Code due to the lot’s irregular shape and, subsequently, triggered a code assessment development application.

Once constructed, the proposed dwelling will be consistent and complement the built form and boundary setbacks prevailing in the street and local area.

Residential RiskSMART Approval - Baza Place, Banksia Beach

The Planning Place has successfully obtained approval for a new Dwelling House at 17 Baza Place, Banksia Beach. Under the Moreton Bay Regional Council Planning Scheme 2015, a compliant dwelling house is considered self-assessable within the General Residential Zone – Suburban Neighbourhood Plan. However, the development triggered a code assessable development application where a non-compliant front setback was proposed.

In conjunction with the town planning report, a Flood Check Property Report and Dux Creek Preliminary Approval were provided to support the proposal. Council approval was granted early November. 




Residential Approval - Fred Street, Camp Hill

The Planning Place has successfully obtained Preliminary Approval and a Development Permit for a Dwelling House at 7 Fred Street, Camp Hill. The two-storey dwelling house involved design features including a double garage and entry hall, four bedrooms, a media room, family and dining room and a deck. The development triggered a code assessable development application where non-compliant with the Dwelling House (Small Lot) Code. It was argued that the proposed non-compliances relating to setbacks were suitably minor and achieved the performance outcome. The approved dwelling is designed to ensure natural light, sunlight and breezes are provided.

The Planning Place also made a successful request to Asset Services to remove a street tree and allow the proposed driveway to be installed lawfully.

35 Dopson Street, Taringa

The Planning Place has recently obtained approval for a Three Storey House on a Small Lot at 35 Dopson Street, Taringa. Generally unsupported within the Low Density Residential Zone, The Planning Place justified the additional storey as a consequence of the site’s slope and cited minimal crossover so that for the most part the dwelling house presented as two storeys. Precedence within the streetscape achieved against the Brisbane City Plan 2014 was also used to support the proposal.

The approved development required Code assessment against a number of codes including the Dwelling House (Small Lot) Code, Low Density Residential Zone Code and the Toowong-Indooroopilly District Neighbourhood Plan Code. The Toowong-Indooroopilly District Neighbourhood Plan identified the strategic intent for the local area surrounding and including the subject site. The approved Three Storey House did not change the level of assessment in the Toowong-Indooroopilly District Neighbourhood Plan and the proposed development achieved the purpose and overall outcomes of the subsequent code.

12 Jackson Street, Coorparoo

The Planning Place has recently obtained approval for a Dwelling House in a Traditional Building Character Overlay at 12 Jackson Street, Coorparoo. The Brisbane City Plan 2014 identified the application triggered Code assessment where involving building work for a dwelling house subject to the Traditional Building Character Overlay. On land designated as a Character (infill housing) area, the proposed works included a four-bedroom house with a recessed garage and street facing deck and entry porch. The approved dwelling sought to incorporate appropriate building form and traditional elements, detailing and materials to reflect the Traditional Building Character Overlay.

14 Inverness Street, Ascot

The Planning Place has successfully obtained RiskSMART approval for House Extensions at 14 Inverness Street, Ascot. The proposed works predominantly included extensions to the garage and patio on the ground floor and guest room, ensuite and lobby on the first floor. This application triggered Code assessment against the Brisbane City Plan 2014 where involving building work for a dwelling house subject to the Traditional Building Character Overlay. The Planning Place sought a number of performance-based solutions for the corresponding code.

78 Lamington Avenue, Ascot

The Planning Place has successfully obtained approval for a House Extension (Carport) in a Traditional Building Character Overlay at 78 Lamington Avenue, Ascot. The approved Building Work included constructing a double open car port that is positioned within the front setback of the subject site. The approved carport did not achieve a 2m setback or 15m lot width and the proposed carport exceeded 50% of the lot width. As such, it did not qualify as an exempt development and required a Code assessable development application. The carport was designed sympathetically to the existing dwelling and consistent with many other dwellings in the surrounding area.

140 Victor Street, Holland Park

The Planning Place has recently obtained RiskSMART approval for a Three Storey House at 140 Victor Street, Holland Park. The approved development mostly complied with the applicable codes as generally the plans did not overlap aside from approximately 9sqm in the middle of the dwelling. Where the hallway and master bedroom of the third storey overlapped the rear of the garage on the first storey, the dwelling house triggered a Code assessable development application.

12 Moore Street, Milton

The Planning Place has successfully obtained Preliminary Approval for Building Works for a Dwelling House Extension in a Traditional Building Character Overlay at 12 Moore Street, Milton. The works included removing components of the existing dwelling house beyond the point which is highest and rearmost of the roof, and refurbishing and extending to the sides of the dwelling house. The scale of works associated with the development application triggered Code assessment.

17 Normanton Street, Stafford Heights

The Planning Place has successfully obtained RiskSMART approval for a 1 into 2 Lot Subdivision at 17 Normanton Street, Stafford Heights. The approved development involved the removal of the existing high set dwelling house and pool to provide for two front facing lots each with a frontage width of approximately 10 metres.

Confirmation from Brisbane City Council and Asset Services regarding the removal of street trees in the road reserve ensured that the development application remained suitable for RiskSMART.

Performance solutions were sought with regard to the lot width of parent Lot 1. The existing lot was slightly irregular, however, was common for lots in the Stafford Heights area. The approved design responded intelligently to the site’s shape that would enable dwelling houses to be comfortably positioned and would not result in negative amenity impacts of neighbouring lots.

Residential Approval - Fraser Street, Shornclffe

Recently, The Planning Place successfully obtained approval for a new Dwelling House in the Traditional Building Character Overlay at 3 Fraser Street, Shorncliffe.

The approved development was considered consistent with pre-1946 character buildings through the use of external elements such as eves, overhangs, materials and upper floor storey projection. Using the precedent example of 7 Fraser Street, Shorncliffe, The Planning Place justified the adaptation of a character partial split skillion roof style presenting to the street. Skillion roof forms did form part of pre-1946 streetscapes, primarily as carports and lean-to’s but were not a foreign roof form in a character residential area. The proposed Dwelling House was also subject to the Flood overlay where the building pad partially encroached into the creek/waterway flood planning area. A flood report was used as part of the development application to ensure the proposed filling would have negligible impact upon upstream and downstream landowners.

A garden shed was also proposed and involved building works, but where less than 25m2, the proposed shed was exempt from assessment against the Traditional Building Character (design) Code and the Flood Overlay Code.

The Planning Place has successfully obtained approval for a Material Change of Use for a Low Impact Industry Extension at Unit 3, 19 Lear Jet Drive, Caboolture. 

The proposed development is defined under the Moreton Bay Regional Council Planning Scheme as a Low Impact Industry:

"Premises used for industrial activities that include the manufacturing, producing, processing, repairing, altering, recycling, storing, distributing, transferring or treating of products and have one or more of the following attributes:

o   negligible impacts on sensitive land uses due to off-site emissions including aerosol, fume, particle, smoke, odour and noise;

o   minimal traffic generation and heavy-vehicle usage;

o   demands imposed upon the local infrastructure network consistent with surrounding uses;

o   the use generally operates during the day (e.g. 7am to 6pm);

o   off-site impacts from storage of dangerous goods are negligible; and

o   the use is primarily undertaken indoors."

 The works involve extending an existing low impact industry use internally to an existing industrial unit. The extensions will incorporate an additional gross floor area of 101m2 for a mezzanine floor build.

The Planning Place has successfully obtained approval for a Material Change of Use (Food and Drink Outlet and associated Hotel) at 96 Albert Street, Brisbane City. The premises is occupied by a six storey office building which will be retained in its existing built form and level one will be retrofitted into a Korean barbecue restaurant that includes a small bar.

Under the Brisbane City Plan 2014, a Food and Drink Outlet is defined as follows:

“Premises used for preparation and sale of food and drink to the public for consumption on or off the site. The use may include the ancillary sale of liquor for consumption on site. Examples include bistro, cafe, coffee shop, drive-through facility, kiosk, milk bar, restaurant, snack bar, takeaway, tearoom.”

Under the Brisbane City Plan 2014, a Hotel is defined as follows:

“Premises used primarily to sell liquor for consumption. The use may include short-term accommodation, dining and entertainment activities and facilities. Examples include bar, pub and tavern.”

As per the Centre or Mixed Use Code, where the proposed use is a Hotel, the use may not generate noise which is clearly audible and detectable, or impacts on the amenity of a resident, in a dwelling or other sensitive use. As the use on the second level of an existing office building, an acoustic report was undergone to satisfy this requirement.

Commercial Approval - Child Care - Barbour Road, Bracken Ridge

The Planning Place has successfully obtained approval for an Extension to Childcare Centre at 128 Barbour Road, Bracken Ridge (reference number: A004338268). The approved development is consistent with the planned intent for the area, as it provides essential services to the local community from 86 child places to 201 child places (including 45 out of school hours care students). The approved works involve and increase in Gross Floor Area that incorporates child spaces, amenities and kitchen on the North-Eastern side of the property, along two street frontages. No change in the hours of operation was proposed. 

Access to the site will be improved with a new vehicle crossover strategically located along Barbour Road so that it poses minimal reduction to efficiency to the intersection and compliments pedestrian activity throughout the site. An additional 17 car parks will also be provided in accordance with the existing child care approvals and will be buffered with vegetation landscaping. 

Where located within the Emerging Community Zone, the proposal required a Material Change of Use development application subject to Impact Assessment. Public notification for the impact assessable development began on the 27th July, 2016, and was maintained up to and including 19th August, 2016, in accordance with the manner prescribed by the Sustainable Planning Act 2009. The public notification signs were erected on the frontage of Barbour Road and on the frontage of Norris Road and during this time. 

Located within the Bracken Ridge and District Neighbourhood Plan and subject to several overlays including the Bicycle Network Overlay, Road Hierarchy Overlay and Streetscape Hierarchy Overlay, the proposed development required assessment against the respective codes in the Brisbane City Plan 2014. The proposal was also read in conjunction with a site based stormwater management plan report, tree assessment and acoustic report to comprehensively assess the suitability of the site for an increased intensity of use. Council approval was received in October, 2016, subject to reasonable and relevant conditions.
